10月25日,深圳市住建局网站发布《关于我市住房公积金租房提取有关事项的通知》。《通知》规定,深圳无房的缴存职工可按月应缴存额的100%提取住房公积金,其中,符合条件的多子女家庭、承租公共租赁住房的职工可选择按实际月租金提取住房公积金。《通知》自2023年11月1日起施行,有效期一年,职工应当在《通知》有效期期内按规定申请办理此期间月份的租房提取业务。
On October 25, the Shenzhen Municipal Bureau of Housing and Construction website released Notice on Matters Relating to the Rental Withdrawal of Housing Provident Fund in the City. The Notice stipulates that contributing employees who do not own a house in Shenzhen can withdraw housing provident fund according to 100% of the monthly amount of deposits payable, among whom the eligible families with multiple children and employees renting public rental housing can choose to withdraw housing provident fund according to the actual monthly rent. The Notice comes into force on November 1, 2023, and will be valid for one year. Employees should apply for the rental extraction within the validity period of the Notice in accordance with the regulations during this period.

On October 23, the Tianjin Municipal Human Resources and Social Security Bureau website released the Notice on Adjustment of Tianjin Minimum Wage Standard. The Notice specifies that the monthly minimum wage standard was adjusted from RMB 2,180 to RMB 2,320. The minimum hourly wage standard for part-time employment was adjusted from RMB 22.6 to RMB 24.4. The Notice is effective from November 1, 2023.

《企业档案管理规定》十月一日起正式生效
Regulation on the Management of Enterprise Records Came into Effect on October 1
国家档案局公布的《企业档案管理规定》,自2023年10月1日起正式施行。《规定》对企业档案工作提出了更加明确、具体的要求,有利于保障企业档案信息资源的完整安全。《规定》共十章七十七条,其中规定了企业档案保管期限分为永久和定期,定期一般分为30年和10年;档案备份应当定期开展,至少每年备份一次;档案库房视频监控记录应当至少保存6个月。《规定》还明确了企业档案工作要接受档案主管部门检查,企业总部也要对所属单位档案工作进行考核。
The Regulation on the Management of Enterprise Records, published by the National Archives Bureau, came into force on October 1, 2023. The Regulation consists of 10 chapters and 77 articles, which stipulate that the duration enterprise archives preservation shall be permanent or terminable, and the term is usually 30 years or 10 years; the backup of archives should be carried out on a regular basis, at least once a year; and the archive storage room video surveillance records should be kept for at least six months. It is also clear that the preservation work should be supervised by the archives department, and the headquarters of enterprises should also evaluate their preservation work.

All-China Federation of Trade Unions Released a New Version of the Constitution of Chinese Trade Unions
10月15日,全国总工会官网发布新版《中国工会章程》。新《章程》明确新就业形态劳动者入会权利,明确区域性、行业性工会联合会组织形式,规范基层工会委员会名称和任期,明确工会干部能力本领要求等,有利于各级工会持续深化改革和建设,有效发挥党联系职工群众的桥梁纽带作用。
On October 15, the All-China Federation of Trade Unions released a new version of the Constitution of the Chinese Trade Unions on its official website. The new Constitution clarifies the rights of workers in new forms of employment to join trade unions, defines the forms of regional and industrial trade union federations, standardizes the names and terms of primary-level trade union committees, and specifies the requirements for the competence of trade union officials, which will help trade unions at all levels to continue deepening their reforms and construction and effectively play their role as the bridge and link to the employee masses.
北京发布2023年企业工资指导线
Beijing Issued the 2023 Corporate Wage Guideline
10月19日,北京市人社局、北京市总工会、北京企业联合会/北京市企业家协会、北京市工商业联合会共同发布《关于发布北京市2023年企业工资指导线有关问题的通知》。《通知》明确,北京市2023年企业工资指导线,以企业职工平均工资增长率的形式发布,具体体现为两条线:即基准线和下线。今年的基准线为5.1%,下线为2.8%。
On October 19, Beijing Human Resources and Social Insurance Bureau, Beijing Federation of Trade Unions, Beijing Federation of Enterprises/Beijing Entrepreneurs' Association, and Beijing Federation of Industry and Commerce jointly issued the Notice on Issues Relating to the Beijing Enterprise Wage Guideline for 2023. The Notice clarifies that Beijing's 2023 enterprise wage guideline is issued in the form of the growth rate of the average wage of enterprise employees, which is demonstrated by two lines: the baseline and the lower line. This year, the baseline is 5.1% and the lower line is 2.8%.

10月25日,上海市普陀区人民法院发布了十件劳动争议典型案例。相关案例坚持保护劳动者合法权益和维护企业良性健康发展并重,旨在引导构建依法合规的企业用工秩序,妥善化解各类劳动纠纷。这批典型案例一是回应民生关切,平衡劳资双方利益。如案例五中,切实维护了女职工“三期”权益。二是回应规则解析,加强类案示范效应。如案例一中,具体阐释了用人单位调岗的合理性认定规则。三是回应司法立场,彰显德润人心理念。如案例二,以判决的方式亮明司法态度,弘扬了诚信的社会主义核心价值观。
On October 25, the Shanghai Putuo District People’s Court released ten typical cases of labor disputes. The relevant cases adhere to the protection of legitimate rights and interests of workers and the maintenance of sound and healthy development of enterprises, aiming at construction of an employment market in compliance with the law, and proper resolution of various types of labor disputes. First, these cases respond to employees’ concerns and balanced the interests of employers and employees. For example, Case 5 emphasizes the rights and interests of female workers during the “three periods”. Secondly, the cases implement relevant rules and strengthened the demonstration effect of similar cases. For example, Case 1 interprets and implements the rules for determining the lawfulness of job transfer ordered by the employer. Thirdly, the cases demonstrate judicial tendency, showing the concept of moral integrity. For example, Case 2 clarifies the judicial tendency to promote the Socialist Core Values of honesty and integrity.

员工被依法限制人身自由,用人单位该如何应对?

【案例引入】某公司规定员工申请三天以内的病假不需要提供病假单。员工甲申请三天的病假以后,期满仍未返岗且未向公司说明理由,处于失联状态。公司通过甲预留的家属联系方式得知甲被警方带走调查,但具体的原因其家属未向公司透露。
类似情形在公司管理过程中并不鲜见,在员工被公安部门依法限制人身自由期间,劳动关系以及工资、社保的处理成为了困扰公司的难题。本文旨在为公司提供解决上述问题的合规思路。

用人单位单方调整工作岗位的合法合理性探讨

依据《劳动合同法》的规定,“用人单位与劳动者协商一致,可以变更劳动合同约定的内容。变更劳动合同,应当采用书面形式”,而作为劳动合同的内容、劳动合同履行的要素之一,工作岗位的调整,除特定法定情形外,理论上必须与劳动者协商达成一致后方可变更。然而,员工的工作岗位及相应的工作内容同时也是企业的经营运营状况的呈现,随着企业的动态发展和市场经济环境的变化,企业的经营运营业务状况也需要相适应地进行调整,这也势必导致了岗位调整的需要,因此实践中在确有生产经营客观需要的情况下,用人单位也有一定的自主管理权,可以单方地对劳动者的岗位进行调整。而当这一企业经营需要和劳动者的岗位选择权有所冲突时,并没有法律依据对何种情形属于“确有需要”、调整的范围和尺度进行说明和定性。因此,笔者通过对劳动争议多发地区有关“单方调岗”的案例进行检索对用人单位单方调整工作岗位的合法合理性进行探讨。
