The 18th Trans-Pacific Maritime Conference was held in Long Beach, USA, from February 26 to March 1, 2023. The theme of this conference was "Picking Up The Pieces", and over 2,500 guests from shipping and related industries from around the world attended the conference. This session conducted in-depth discussions on international economic, financial, trade situation, shipping market development, logistics supply chain management, e-commerce, blockchain technology, and other issues.

《福建省海上搜寻救助条例》
Regulations on Maritime Search and Rescue of Fujian Province
经福建省第十三届人民代表大会常务委员会第三十六次会议审议通过,《福建省海上搜寻救助条例》2023年1月1日起正式实施。该《条例》包含总则、机构和职责、搜寻救助行动、搜寻救助保障、法律责任、附则等六章,共四十九条,不仅设计完善了海上搜救工作机制,明确了各方职责,对搜救行动的全流程进行了规范,而且对搜救资源保障作出了详细规定。
After deliberation and approval at the 36th meeting of the Standing Committee of the 13th People's Congress of Fujian Province, the Regulations on Maritime Search and Rescue of Fujian Province was officially implemented on January 1, 2023. The Regulations contain six chapters, including general provisions, institutions and responsibilities, search and rescue operations, search and rescue security, legal responsibilities, and supplementary provisions, with a total of 49 articles. The regulations improve the maritime search and rescue work mechanism, clarify the responsibilities of all parties, standardize the entire process of search and rescue operations, and provide detailed provisions for the security of search and rescue resources.

Administrative Measures on the Safety of Offshore Wind Power Navigation of Shandong Maritime Safety Administration (Provisional)
为了加强海上风电建设、运维期间海上交通安全管理,维护海上通航秩序,保障船舶航行、停泊和作业安全,防止船舶污染海洋环境。2023年1月29日,山东海事局发布《山东海事局海上风电通航安全管理办法(暂行)》,共包括总则、通航保障、建设管理、运维管理、监督管理、附则共六章46条。
In order to strengthen the management of maritime traffic safety during the construction, operation and maintenance of offshore wind power, maintain the order of maritime navigation, ensure the safety of ships' navigation, berthing, and operations, and prevent ships from polluting the marine environment. On January 29, 2023, the Shandong Maritime Safety Administration issued the Administrative Measures Administration on the Safety of Offshore Wind Power Navigation of the Shandong Maritime Safety (Provisional), which contain six chapters, including general provisions, navigation security, construction management, operation and maintenance management, supervision and management, and supplementary provisions, with a total of 46 articles.

Regulations on the Safety of Maritime Traffic of Offshore Wind Farm of Shanghai Maritime Safety Administration
为了加强辖区海上风电场建设施工和运行维护的海上交通安全监督管理,保护人民群众生命和财产安全,保障船舶、海上设施航行、停泊、作业安全,上海海事局依据《中华人民共和国海上交通安全法》等法律法规和国家行业标准,制定了《上海海事局海上风电场海上交通安全管理规定》,该规定于2023年1月1日正式生效。
In order to strengthen the supervision and management of marine traffic safety in the construction, operation and maintenance of offshore wind farms, protect people's lives and property, and secure the safety of navigation, berthing and operation of ships and offshore facilities, the Shanghai Maritime Administration, in accordance with the Maritime Traffic Safety Law of the People's Republic of China and other laws and regulations and national industry standards, has formulated the Regulations on the safety of Maritime Traffic of Offshore Wind Farm of Shanghai Maritime Safety Administration, which officially came into effect on January 1, 2023.

Regulations on Ship Pollution Prevention and Control of Shanghai Municipal
《上海市船舶污染防治条例》已由上海市第十五届人民代表大会常务委员会第四十七次会议于2022年12月21日通过,自2023年3月1日起施行。此次立法强化船舶污染防治的主体责任、关注到噪声污染、以及内河船舶上的生活垃圾和污水。在《条例》的赋权下探索划定特定水域为上海市绿色航运示范区,打造船舶污染防治的“上海样板”。
Regulations on Ship Pollution Prevention and Control of Shanghai Municipal were adopted by the 47th meeting of the Standing Committee of the 15th Shanghai Municipal People's Congress on December 21, 2022 and will come into effect on March 1,2023. The legislation strengthens the main responsibility of ship pollution prevention and control, and focuses on noise pollution, as well as domestic waste and sewage on inland ships. Under the authority of the Regulation, specific waters will be designated as Shanghai Green Shipping Demonstration Zones, creating a "Shanghai model" for ship pollution prevention and control.

《江苏省长江船舶污染防治条例》于2023年3月1日起施行,该《条例》是在《长江保护法》基础上,围绕长江船舶污染防治领域主要矛盾进行补充细化而制定的符合江苏省实际的一部地方性法规。
Regulations on the Prevention and Control of Pollution from Ships on the Yangtze Rive of Jiangsu Province came into effect on March 1 2023. The regulations were local regulations formulated on the basis of the Yangtze River Protection Law, which is in line with the actual situation of Jiangsu Province and focuses on the main contradictions in the field of ship pollution prevention and control in the Yangtze River.

In order to ensure the smooth navigation of channels and the safety passage of ship , promote the high-quality development of water transport, and regulate the collection and use management of ship passage fees in the province, the former Measures on the Collection and Use of Ship lockage Fees of Jiangsu Province has been comprehensively revised and the new Measures will come into effect on April 1, 2023.

为加强船舶引航安全监督管理,规范船舶引航行为,维护船舶引航秩序,保障人命财产和水域环境安全,长江海事局拟定了《长江海事局船舶引航安全监督管理办法》,该办法于2023年4月1日起施行。
In order to strengthen the supervision and management of ship pilotage safety, standardize ship pilotage behavior, maintain the order of ship pilotage, and protect the safety of human life, property and the water environment, the Changjiang Maritime Administration has formulated the Measures for the Supervision and Administration of Ship Pilotage Safety of Changjiang Maritime Safety Administration, which will come into effect on April 1, 2023.

In 2022, Shanghai Maritime Court continued to deepen its strategy of excellence in maritime adjudication and concluded a number of cases of typical significance in a fair and efficient manner. Among these cases, including applications for recognition for judgments of foreign court, disputes over maritime insurance contracts, disputes over liability for ship collisions, disputes over general average, disputes over contracts for carriage of goods by sea and other types of cases. Shanghai Maritime Court has carefully selected the ten best cases to be published in terms of establishing rules of adjudication, innovative adjudication methods and reflecting service protection functions.

After discussion and approval by the third judicial committee in 2023, Guangzhou Maritime Court announced the top ten typical cases in 2022. These include disputes over contracts for carriage of goods by sea, disputes over liability for damage to maritime property, administrative litigation and administrative compensation cases for the compulsory demolition of illegal breeding facilities, disputes over liability for damage caused by ship collisions, disputes over crew service contracts, disputes over property insurance contracts, and so on.

大连海事法院发布《海事案例参考》第二十九期,以船舶保险合同纠纷案为例,论超航区航行发生的船舶事故是否属于保险责任范围。其认为合同履行期间,对超航区航行显著增加被保险船舶危险程度的情况,被保险人应及时通知保险人,否则超航区航行导致的船舶事故不应认定为保险事故。该案对于更好地发挥航运保险维护海上航行安全、促进国际贸易发展的作用,有着重要的价值导向意义。
Dalian Maritime Court issued the 29th edition of Maritime Case Reference, taking the dispute case of ship insurance contract as an example, to discuss whether the ship accident occurred during navigation beyond the navigation area belongs to the scope of insurance liability. It held that during the performance of the contract, the insured shall promptly notify the insurer of any significant increase in the risk level of the insured vessel due to navigation beyond the navigation area, otherwise the vessel accident caused by navigation beyond the navigation area shall not be recognized as an insured event.

Xiamen Maritime Court heard an application for recognition of a Singapore judicial administrator by Singapore Xihe Holdings Ltd. and Singapore Xinbo Marine Ltd., a domestic case based on the recognition of foreign insolvency proceedings under corporate insolvency law. Dr. Shouzhi An acted in this case and the judgment was published in the Chinese Maritime and Commercial Law Reports published by Informa UK plc. in Volume 4, 2022.

There is considerable controversy in judicial practice as to whether the carrier, as the insured under cargo insurance, enjoys insurance benefit. In such circumstance, logistics enterprises are likely to list their customer or shipper as the insureds when applying for cargo insurance, but their "customer" may not necessarily be the "cargo owner".

ODI (Overseas Direct Investment) refers to the economic activities in which Chinese enterprises directly or indirectly acquire the ownership, control rights, and management rights of overseas companies. Domestic enterprises have obvious advantages in exploring overseas markets, obtaining local preferential policies or tax benefits, avoiding foreign trade barriers, and increasing added value through ODI.

特殊动产善意取得制度中占有改定的适用与冲突——以一起船舶买卖合同纠纷案中的实际权利人视角
Application and Conflict of Possession Reformulation in the System of Bona Fide Acquisition of Special Movables: From the Perspective of the Actual Right Holder in a Dispute over a Ship Sale Contract.
占有改定虽然被列为动产交付的一种特殊形式,但占有改定作为观念交付的一种,其与实际交付相比,天然不具备外观公示效力,故占有改定作为交付形式应该被严格限定适用范围。具体而言,在受让人主张基于善意取得获得船舶类特殊动产物权时,其必须完成与让与人之间的实际交付,占有改定不应该在此种情形下得到适用和支持。
Although possession reformulation is listed as a special form of delivery of movable property, as a form of conceptual delivery, it naturally does not have the effect of appearance publicity compared to actual delivery, so possession reformulatio as a form of delivery should be strictly limited in its scope of application. Specifically, when the transferee claims to acquire a special movable property right in ships based on bona fide acquisition, it must complete the actual delivery with the transferor, and the possession reformulatio should not be applied and supported in such circumstances.
